Peter Berry started the practice of Berry Family Law in 2002 initially with a junior lawyer and one other lawyer. Since then Berry Family Law has become one of the best firms in Australia dedicated solely to family law and relationship law.

Our current Managing Partner, James Turnbull became accredited as a Family Law Specialist in 1997 and has worked exclusively in family and relationship law for over25 years.

 While more of James' time is spent in property cases, he advises in the difficult parenting matters, particularly those which involve a request to relocate children interstate or overseas. James has never lost a relocation case.

After separation it is not uncommon for a parent to want to relocate with the children, whether to another suburb, interstate or even overseas.

Custody Arrangements for Children

Clients often ask for legal advice about “custody” arrangements for children. However, under the Family Law Act 1975 (Cth), the concept of “custody” no longer exists. Instead, when deciding parenting Orders the Family Law Courts must consider the issues of: the allocation of “parental responsibility”; which person the children should “live” with; and which person the children should “spend time” with. In all decisions about children, the Court must have regard to the child’s best interests as the paramount consideration.
